Judicial Property Recovery. Extraordinary Usucapion
Appeal to the Civil Section (Sala de lo Civil) of the Supreme Court (Tribunal Supremo) relating to actions for recovering the domain of a castle in the province of Murcia, with the following characteristics:
- One of the parties, the City Council where the castle is located, was who held possession and registration in its favor at the Land Registry (Catastro). The council considered itself owner of de castle by extraordinary usucapion (buying prescription or property acquisition through a long period of possession)
- The other party, the claimants, considered themselves proprietors in virtue of hereditary title registered in the Property Registry (Registro de la Propiedad).
- I received this case from the claimants, with a previous ruling - issued by the Provincial Court (Audiencia Provincial)- rejecting their claim.
- After my appeal, a favorable ruling is obtained, thus giving the claimants their property.
